Within the framework of pre-trial proceedings damage caused to the state and community in the amount of 346.5 million AMD /more than 70%/ has been restored

The RA Prosecutor General’s Office is taking measures to protect the property interests of the state, to restore losses under the conditions of making decisions regarding the rejection of the initiation of criminal case on non-acquittal grounds, termination of proceedings, and termination of criminal prosecution.

 

During the first half of 2019 by the proceedings under the control of prosecutors of the Department for the Supervision over the Investigation of Especially Important Cases of the RA Prosecutor General's Office and territorial divisions of the prosecutor's office, the initiation of criminal proceedings on this basis has been rejected within the framework of 17 materials prepared concerning corruption cases, criminal prosecution has been terminated or has not been carried out within the framework of 86 criminal cases (total 103). 27 out of these have been terminated or the initiation of criminal case has been rejected on the basis of the statute of limitations, 34 cases in connection with the application of amnesty and 39 on the grounds of repentance. In respect of 122 people, decisions have been made not to carry out criminal prosecution.

 

For comparison, we should note that for the same period of 2018, the initiation of criminal case has been rejected on non-acquittal grounds, the criminal proceedings have been terminated or the criminal prosecution hasn’t been carried out or the criminal prosecution has been terminated on the basis of criminal cases initiated concerning 38 corruption cases / that is, 3.5 times less/.

 

This proves the fact that in the first half of 2019, the damage caused to the state and communities within the framework of the above-mentioned criminal cases has amounted to 346.5 million AMD, out of which 248.4 million AMD have been restored voluntarily as a result of warnings from prosecutors. With the use of discretion powers, in all cases of not continuing the criminal prosecution, the damage has been fully restored.

 

Concerning the rest of the damage, appropriate measures have been taken to restore the damage. In particular, the prosecutors have submitted claims within the framework of 4 cases in the amount of 18 million AMD, the investigation of which is in process. And for the same period of 2018 within the framework of these 38 criminal cases, damage in the amount of 14.8 million AMD caused to the state or communities has been detected, which has been completely voluntarily restored. And in this regard, no claims have been submitted to the court concerning the above-mentioned cases.

 

The prosecutors have also submitted proposals to the relevant state authorities regarding filing of a claim with a view to restore the damage.
