The evidence obtained during the preliminary investigation within the criminal case investigated at Investigative Division of Martuni, Gegharkunik Regional Investigation Department of the RA Investigative Committee substantiated that A. Suvaryan, the acting head of Vaghashen community of Gegharkunik region received salary of 952.445 AMD, misappropriating the large amount entrusted to him without attending work for 85 working days, being outside the territory of the Republic of Armenia during 2015-2017.

 

Besides, Artur Suvaryan has confirmed with his signature and seal five executive acts containing false information on the maintenance of the vehicle GAZ 31105 on the balance of the community for technical and provision services. On the basis of these false data "Car Service Station of Martuni" OJS company repaired his personal vehicle TOYOTA LAND CRUISER 4.5 equal to 1,150,000 AMD which was transferred from Vaghashen Community. So, by means of abusing official position, the head of the community misappropriated the large amount from the community budget entrusted to him.

 

The preliminary investigation substantiated that during the period from August 2017 to January 2018, K. Suvaryan, a resident from Vaghashen village, registered as a beneficiary in the Martuni Regional Social Agency of the Staff of the RA Gegharkunik Marzpetaran, was actually hired as a driver of the community, paying a monthly salary for his work without registering him as an employee. In this means he supported K. Suvaryan misappropriating from the same agency a total of 712,500 AMD.

 

In the frame of committing the above-mentioned criminal acts, A. Suvaryan was charged with Article 179, Part 2, Points 1 and 3, Article 314, Part 1, Article 38-178, Part 2, Point 2 of the RA Criminal Code.

 

Within the same criminal case, A. Hakobyan, the director Car Service Station of Martuni LLC was charged under Article 38-179, Part 2, Points 1 and 3, Article 38-314, Part 1 of the RA Criminal Code for assisting the Head of Vaghashen community for taking part in the formation of executive acts, which is an official document, on the basis of which they misappropriated 1.150.000 AMD from the community budget.

 

On June 16, 2020, the prosecutor supervising the legality of the preliminary investigation confirmed the indictment, and sent the criminal case against these two people to the Court of First Instance of Gegharkunik Region of the Republic of Armenia for examination.

 

In the result of the expedited examination in the court, the accusing prosecutor mediated for the defendant A. Suvaryan for imprisonment. On July 20, 2020 the court found the Head of Vaghashen Community guilty in all charges against him and fined him 1.500.000 AMD. Taking into account that the latter had fully repaired the caused damage, pleaded himself guilty, gave confessional testimony, has elderly parents and disabled mother in care. Based on the Law “On declaring amnesty in criminal cases on the occasion of the 2800th anniversary of the founding of Erebuni-Yerevan and the 100th anniversary of the independence of the First Republic of Armenia” A. Suvaryan was released from serving the main sentence of the fine.

 

As an additional punishment, the latter was deprived of the right to hold managerial positions and responsible person for logistics in local self-government bodies and organizations for 2 years.

 

By a separate judicial act, the criminal prosecution against A. Hakobyan, the director of Car Service Station of Martuni LLC was terminated on the basis of the law on amnesty.
