The Prosecutor's Office has filed a lawsuit in order to confiscate the 611 million AMD damage caused to the state by means of corruption in the water company

It was affirmed in the result of the preliminary investigation of the criminal case investigated in the General Department of Investigation of Particularly Important Cases of the Investigative Committee of the Republic of Armenia that during 2003-2011 the person who was the Chairman of Administrative Board and the Executive Director of the water company "Masis" abusing his official position, misappropriated the property of the RA entrusted to him, the particularly large amount of money – 611.072.640 AMD, personally or with a group falsified or induced the group to falsify official documents exempting from liability.


 
In particular, having the obligation to provide the utilization and maintenance of irrigation systems according to the statutes of the company, the latter, using its official position during 2006-2010 dismantled, stole from pipe line situated in Nizam community of Ararat region passing to the Ayntap community with a particularly large size, with a total market price of 403,920,000 AMD with the length of 1020mm and 207,152,640 AMD market value with 2880mm length and 820mm diameter.

 

Later, with the intention of hiding his commitment, abused his authority, persuaded 5 members of the commission of the company established according to his order of 01.12.2011 not to make the annual inventory of the essential means, stating that those funds are available, they are in their place. The members of the commission acting with prior consent, did not conduct the year-end inventory and mandatory actions in accordance with established        procedure.  


 
Instead, they included in the inventory list of essential means not real, false information about alleged inventory, stating the existence of all essential means, including the stolen pipeline mentioned above.

 

Then, the list of fake inventory - the official document eliminating responsibility, was approved by the signatures of the members of the commission, handed over to the accountant of the company.

 

Besides, the WUA Executive Director, acting with the intention of hiding the fact of embezzlement, with the prior consent of the group, confirmed with his signature of 20.12.2011 together with 4 employees of the company the Act of Acceptance/Delivery of the essentials means of the water company, which included not real, false information that he supposedly delivered and the new director accepted all the essential means of the company, including the stolen pipeline. That is to say, the group forged an official document exempting from liability, which was handed over to the company's accounting service.


 
A. D., the Executive Director of "Masis" WUA was charged with Article 179, Part 3, Point 1, Article 38-325, Part 2 and Article 325, Part 2 of the RA Criminal Code for the above-described crime.        

                        
 
On August 14, 2020, the indictment was confirmed by the decision of the prosecutor supervising over legality of the preliminary investigation and the criminal case was sent to the General Jurisdiction Court of First Instance of Ararat and Vayots Dzor Regions.


 
Taking into account that during the preliminary investigation A. D. has not voluntarily recovered the material damage caused to the state, a lawsuit was filed by the Department for Combating Corruption Crimes of the General Prosecutor's Office of the Republic of Armenia to the General Jurisdiction Court of First Instance of Ararat and Vayots Dzor Regions in order to confiscate the total damage of 611.072.640 AMD caused to the state in favor of state budget.
 


The property belonging to the accused was seized during the preliminary investigation in order to provide proper confiscation.
