As already reported, the results of the work carried out by the instruction of the RA Prosecutor General from 01.01.2019 to 30.06.2020 in the direction of identifying corruption abuses registered in the processes of lease, sublease and alienation of municipal and state real estate and the provision of a criminal-legal assessment were analyzed.

 

In the course of the study, it was found that both the RA Prosecutor's Office and other bodies of criminal prosecution were taking consistent measures to subject to criminal liability those who have committed crimes of a similar nature and to restore the damage caused to the state.

 

In particular, for the 1st half of 2020, 49 persons were charged within the framework of criminal cases investigated in the proceedings of the competent bodies of the RA regarding corruption abuses in the processes of lease, sublease and alienation of municipal and state real estate, which is about 32.5% more compared to 2019 (37 persons).

 

During the specified 1.5 year, charges were brought for various corruption abuses in the processes of lease, sublease and alienation of municipal and state real estate, in particular against 34 former heads of communities, including 2 former mayors of Yerevan, 15 current leaders of community, including mayor of Abovyan, former minister of defense, former chairman of the SRC, former deputy chairman of the SRC, head of the RA cadastre unit, former president of the FFA, head of the regional department of the National Security Service, director of the state CJSC, head of the SNCO, head of the department of municipality of Yerevan, deputy head of the department of municipality of Yerevan, chief auditor, expert, as well as against to 18 citizens involved in these abuses.

 

Most of the criminal cases are at the preliminary investigation stage, 5 criminal cases against 9 persons were sent to court with indictment.

 

By the criminal case sent to court for the 1st half of 2020 a civil lawsuit in the amount of 39 million AMD was filed, and within the framework of 1 criminal case suspended on non-acquittal grounds a civil lawsuit in the amount of 22 million AMD was sent to the court by the prosecutor's office.

 

Within the framework of completed in 2019 materials and criminal cases, as well as cases sent to the court with indictment the damage caused to the state amounted to 956 million AMD, and sum in the amount of 70 million AMD was recovered from this amount.

 

From the mentioned criminal cases, by 1 was rendered a conviction against 4 persons, after which in 2020 the RA Prosecutor General submitted to the RA Minister of Territorial Administration and Infrastructures a proposal to initiate the process of returning the mentioned landplots.

 

Besides that, by one criminal case the Department for the Protection of State Interests of the RA Prosecutor's Office in 2020 filed a lawsuit demanding to cancel the process of land alienation process (55.88 ha).

 

The RA Prosecutor General's Office also presented the initiations to submit proposals for the cancellation of illegal transactions, the return of properties alienated by criminal schemes, and the submission of such claims to protect the state interests in the course of the preliminary investigation too and information on the results will be provided along with the provision of final results.
