With a view to verify the new data obtained regarding the use of the alleged violence against the person brought to the police station, the RA Prosecutor General initiated a criminal case

The Prosecutor General's Office of the Republic of Armenia continues its criminal policy with regard to the mandatory verification of the data obtained regarding the torture of people in police stations and other state bodies, ill-treatment and violence within the framework of criminal proceedings.
On June 2, 2020 from Kotayk Division of the RA Police to the Investigative Division of Abovyan of the RA IC, a message was received that on the previous day, within the framework of criminal case by examination injuries were found on the body of the accused S.G.
In fact, as part of the preparation of materials in Abovyan Investigative Division of the Investigative Committee of the RA S.G. gave an explanation that in connection with the above bodily injuries he did not want to answer any questions, received them as a result of falling down, but did not want to say where and in what circumstances. He also said that he has no complaints regarding that, refused to undergo a forensic medical examination, asking us to leave the prepared materials without consequences.
The body conducting the proceedings gave an instruction to the RA Police through the appropriate operative-search measures to find out the real circumstances of receiving bodily injuries as well as the authenticity of the explanation. According to the received letter, it was not possible to find out the real circumstances of his bodily injuries due to the fact that S. G. was kept in "Hrazdan" penitentiary institution of the RA Ministry of Justice.
In the result of the assessment of factual data obtained in the course of the preliminary investigation, the body conducting the proceedings considered approved, that S. G. recived the mentioned bodily injuries as a result of falling down and on that justification on 10.06.2020 a decision was rendered to reject the initiation of criminal case on the basis of the absence of corpus delicti.
On 08.09.2020 in the RA Prosecutor General’s Office was received the application of S. G. regarding that on 01.06.2020 after being taken to Kentron Division of Yerevan Department of the RA Police he was beaten and humiliated by the same division. Thus S. G. presented new data regarding his bodily injuries, which were unknown to the body conducting proceedings in the course of the preparation of materials.
Taking into account that factual data were received indicating an alleged crime of abuse of powers with the use of violence by the relevant persons performing the civil service, RA Prosecutor General Artur Davtyan canceled the decision of the investigator to refuse the initiation of a criminal case on the basis of materials prepared in connection with bodily injuries of S.G., and initiated a criminal case under Part 2 of Article 309 of the RA Criminal Code.
With a view to conduct preliminary investigation the criminal case was sent to the RA SIS.
Notice: Every person suspected in or charged with a criminal offense shall be presumed innocent unless proved guilty in the manner prescribed by the RA Criminal Procedure Code and unless the verdict comes into legal force.
