The RA Prosecutor General's Office summarized the results of the activities of the RA Prosecutor's Office for the first year after the RA Law “On confiscation of property of illegal origin” came into force on 03.09.2020.

 

Accordingly, in order to verify the grounds for the study regarding the presence of property of illegal origin and to make appropriate decisions by the Department for Confiscation of Property of Illicit Origin of the RA Prosecutor General's Office (hereinafter: the Department) regarding the data found out as a result of information received from the subdivisions of the Prosecutor's Office, operational-search measures and a verdict based on 3 materials in the specified period was studied the property of 247 persons.

 

As part of this, the necessary evidence is collected to submit the relevant claims to the court. In particular, by the competent authority was carried out and is being carried out actions aimed at proper and effective implementation, including about 2200 requests were drawn up and forwarded, and 165 instructions were given on the implementation of operational-search measures.

 

On the basis of the responses received as a result of the mentioned measures, calculations and legal analyzes are carried out aimed at combining the legal income and expenses of persons.

 

As part of the studies, applications were submitted to the Court of First Instance of General Jurisdiction of Yerevan city with a view to obtain information constituting banking, insurance, commercial and / or notarial secrets.

 

With a view to establish the market value of property of illegal origin, by the prosecutors of the Department were assigned 14 examinations, by 7 of them a conclusion was received.

 

Within the framework of 10 studies, requests were submitted on the application of measures of preliminary security of the claim, which have already been approved.

 

According to 10 studies completed during the specified period, 90 immovable and 19 movable properties were found out, as well as a total of 21.721.395.028 AMD.

 

All interested people identified based on the materials of the above studies through the online platform “Azdarar” were notified by the Department of expressing their position in connection with getting acquainted with the materials collected as a result of studies regarding the presence of property of illegal origin belonging to them. Some of these people have already submitted and received the materials of the study, and also presented their position, which means that in near future, claims on confiscation of property of illegal origin will be submitted to the court.

 

In addition to the above, by 10 cases, applications for preliminary securing of the claims will also be submitted to the court.

 

International requests were also sent for a dozen of investigated cases.

 

Studies on other proceedings are continuing and all measures provided for by law are being taken to ensure their completeness and integrity in the direction of objective final conclusions regarding the presence or absence of property of illegal origin and the acquisition of data on property registered under the name of these people.
