Disciplinary sanctions in the form of “reprimands" against the Prosecutor of Military Prosecutor’s Office of Sevan Garrison

According to the order of Prosecutor General Anna Vardapetyan of March 6, 2023 Disciplinary sanctions in the form of “reprimands" was appointed against the Prosecutor of Military Prosecutor’s Office of Sevan Garrison.
It was confirmed that in the framework of disciplinal proceedings, the person taking the autonomous position in the Military Prosecutor’s Office of Sevan Garrison, being responsible for defending the legitimacy of public indictment, made negotiations in the scope of the proceedings. In the result the accuser came to an agreement with the prosecuting party to appoint punishment against the accused in the form of imprisonment in the case, when according to Article 67, Part 5 of the RA Criminal Code the person, who committed crimes not of great gravity at the first time, wouldn’t be imposed to imprisonment.
On its turn, the First Instance Court of General Jurisdiction of Gegharkunik region, ignoring the above-mentioned demand of law, violating the demands of Article 461, Part 3 of the RA Criminal Procedure Code (the court doesn’t adopt the protocol on consent, if agreed punishment is illegal) and adopting the mentioned protocol on consent, rendered a judgment imposing imprisonment for 6 months, and conditionally not applying this, the court defined a probation period for 1 year.
