The State Interests Protection Department of the Prosecutor General's Office of the Republic of Armenia received documents and information from the RA State Property Management Committee on "Radioisotope Production Center" CJSC, as well as the outcomes of inspection carried out by the RA Ministry of Finance in the mentioned CJSC in October, examined the state of compliance with the requirements of law. In the result, apparent criminal abuses were discovered.

 

In particular, on the basis of the contract of 20.09.2012 concluded between "Radioisotope Production Center" CJSC and N LLC for the performance of construction works for 832.026.000 AMD.

 

However, with the control measurements of the construction works it was discovered that work for 3.7 million AMD, approved and paid according to the protocols of delivery -acceptance were not actually performed.

 

Besides, according to the signed agreement, the price of the contract was changed and amounted to AMD 791.196.400 and according to another agreement concluded in 2013, it was changed and amounted to 872.590.300 AMD.

 

According to another contract concluded on 24.03.2014 for 1.042.413.200 AMD between the company and the same LLC, the LLC undertook to perform the works of interior decoration, external and internal engineering systems acquisition, installation, adjustment of Cyclotron 18/18 cyclotron installation building.

 

Both on 20.09.2012 and on 24.03.2014. the deadlines for the execution of the contracts have been continuously changed and deadlines have been set for December 30 and 31  of 2015  accordingly which violating the Decision № 168-N of the Government of the Republic of Armenia dated 10.02.2011., the requirements regarding the limitations envisaged for changing the terms and conditions provided in the contract.

 

According to these contracts: "In case of violation of the deadline of the work execution, the contractor shall be charged with penalty for each day of delay in the amount of 0.05 percent of the price of unfinished works.

 

However, it was found out, that in one case the works with the amount of 181.080.200 AMD, and in the other case 488.046.400 AMD were performed after the scheduled deadlines, and the penalties to be charged for each late day with the amount of 64.819.400 AMD in total, were not calculated and were not charged.

 

Taking into account that in the result of the study, it was discovered that the officials of "Radioisotope Production Center" CJSC used their official position to steal the property of another person entrusted to them, which reached particularly large sizes, entering false information or notes in the official documents by the officials, the officials used their official position and the outcomes of the study were sent to the RA Anti-Corruption Committee to prepare materials and resolve the process in accordance with Articles 180 and 181 of the RA Criminal Procedure Code.
