A public criminal prosecution against Ye.H., captain, officer of engineer company of the N military unit of the Ministry of Defense of the Republic of Armenia

On February 1, 2023, the supervising prosecutor exercising oversight over the lawfulness of pre-trial criminal proceedings made a decision on initiating a public criminal prosecution against Ye.H., Officer of the engineer company of the N military unit of RA MD  under part 4 of article 532 of the RA Criminal Code.

 

Due to the investigative and other prosecutorial activities undertaken during the preliminary examination of the criminal proceedings examined in the 5th Garrison Investigative Unit of the Military Investigative Department of the Investigative Committee, sufficient facts were obtained, that on January 19, 2023 at 00:40 Ye.H. violated the requirement established by the legislation regarding the handling of gasoline, the most dangerous substance for the environment, pursuant to which the use of gasoline and other flammable liquids for lighting stoves is prohibited for fire safety purposes.

 

Ye.H took one of ten containers filled with gasoline to lit the stove of the shelter envisaged for the engineer-depot company of the N military unit of the RA MD located at house 20 of the 1st Street of Azat village, Gegharkunik region. As a result fire broke out in the shelter.

 

Due to the unscrupulous and negligent treatment to their official duties by several officials of the RA MD and as firefighting measures were not ensured, the military servants, who were in the shelter at that moment were not able to extinguish the fire and because there was no emergency exit, they were not also able to break the iron bars of the windows and get out.

 

Due to the activities of Ye.H, a fire broke out in the shelter and because the staff didn’t have firefighting measures 15 compulsory military servants of the same troop, resting in the shelter, died, the officer and 4 compulsory military servants got bodily injuries of various degrees.

 

Notice:  A person charged with any crime shall be presumed innocent until proved guilty in the manner prescribed by the RA Criminal Procedure Code—by the judgment came into legal force.
