The land leased to the "Youth Palace" was alienated for about 4.4 billion AMD less than the market value

The land parcel with a total area of 31780.0 square meters, which was leased to the former "Youth Palace" SCJS located on 1 Saralanj Street, Yerevan, with a cadastral value of 805 million 623 thousand AMD, and approximate market value of 4 billion 430 million 926 thousand and 500 AMD was alienated for 62 million 973 thousand 405 AMD, on the 16th of January, 2004.

 

In the result of investigation conducted in the Department of State Interests Protection of the Prosecutor General’s Office of the RA, alleged facts have been obtained regarding the use of the official position against the interests of the service by the officials of the Yerevan Municipality, in 2005.

 

In particular on the 16th of January, 2004, the Mayor of Yerevan, breaching the Government Decision No. 286 “On approving the procedure for expropriating and providing use of state-owned land parcels", dated the 12nd of April, 2001, as well as the requirements of the Land Code, illegally alienated the land parcel with a total area of 31780.0 square meters, which was leased to the former "Youth Palace" SCJS located on 1 Saralanj Street, Yerevan, with a cadastral value of 805 million 623 thousand AMD, and approximate market value of 4 billion 430 million 926 thousand and 500 AMD was alienated for 62 million 973 thousand 405 AMD to “Avangard Motors” CJSC, causing particularly large damage to the state.

 

The Department of State Interests Protection of the Prosecutor General’s Office of the RA has obtained factual data that the land parcels with an area of 53.0 square meters and 4854.86 square meters located on 1 Saralanj street were expropriated to "Avangard Motors" CJSC in 2011, for the purpose of expansion, through direct sale; while the land parcel with an area of 53.0 square meters was included in the list of restrictions stipulated by Article 60 of the Land Code and was not subject to expropriation, according to the letter of Yerevan’s Chief Architect-Head of Department of Architecture and Urban development of Yerevan Municipality.

 

On the 20th of April, 2023, the prosecutor submitted a report on the alleged crime to the Anti-Corruption Committee, taking into account the discovery of commitment of an alleged crime by the officials of Yerevan Municipality, notary and other persons.

 

On the 22nd of April, 2022, a criminal case was initiated in the Anti-Corruption Committee according to Article 308, Part 2 (abuse of official authority, which negligently caused grave consequences), Article 314, Part 1 (official forgery) and Article 325, Part 2 (forgery, sale or use of forged documents, stamps, seals, letter-heads, vehicle license plates) of the Criminal Code adopted on 18.04.2003.

 

On the 5th of May, 2023, the Prosecutor General’s Office submitted a lawsuit to the Administrative Court within the framework of the authority to initiate a lawsuit for the protection of state interests.
