The Prosecutor's Office has sent a petition to the head of the Chambarak community to undertake measures to demolish unauthorized structure on a state-owned land plot

Within the framework of the authority to initiate a lawsuit to protect state and community interests the Prosecutor's Office found out that officials of the "Sevan National Park" SNCO (hereinafter referred to as the National Park), violating the procedure and conditions for granting the right to develop land plots that are state and community property, established by the Government's Decision No. 286 of April 12, 2001, recognized a natural person as the winner of the competition.
Based on the outcomes of the competition, the National Park signed an agreement with a natural person on January 9, 2007 for granting the right to develop state-owned land plot.
The right to develop certain parts of the above-mentioned land plot was acquired by the Chairman of the Board of Directors of “Kapavor” LLC during 2018-2020, who, in violation of the procedure established by a number of legal acts and without an environmental impact assessment, carried out construction in the specified area.
Upon the instruction of the Urban Development, Technical and Fire Safety Inspection Body, the decision of the head of Shoghakat (currently Chambarak) community on August 31, 2020 to suspend the operation of the architectural and structural assignment and construction permit, as well as the implementation of construction work on the land plot, the head of the same community issued a new design permit to the Chairman of the Board of Directors of “Kapavor” LLC for the design of a recreation area in the same area on March 5, 2021, indicating the condition of the land plot as an undeveloped area with medium slopes.
Having received a positive state expert opinion from the authorized body based on the design documents developed with a new design permit, but not having the relevant urban development documents, in particular, a construction permit, the Chairman of the Board of Directors of “Kapavor” LLC, in addition to the land plots belonging to him with the right to construction in the administrative territory of the village of Drakhtik, also carried out unauthorized constructions with a total area of 6182 square meters on a 0.2015 ha area located at 88/1/2, 1st Street, Drakhtik, which does not belong to him, as well as on land plots that are state property, out of which 1588 square meters are in the area below the 1905 meter absolute mark.
Based on the above, the Prosecutor’s Office sent a petition to the head of the Chambarak community of Gegharkunik Region to make a decision within the framework of the powers according to Article 42 of the Law “On Local Self-Government” on unauthorized constructions and to take measures to ensure the implementation of that decision.
