The Head of Kotayk region sent a letter to the Prosecutor of Kotayk region regarding the alienation with gross violations of the legislation of the land plot in Ptghni community.

 

The letter and the attached documents were sent by the Prosecutor's Office of the region to the Police Division of Kotayk with an instruction to prepare materials in connection with the circumstances indicated in the letter.

 

In the course of the prepared materials, factual data were obtained that the land plot with an area of 1.443 hectares located in the administrative territory of Ptghni community of Kotayk region was submitted to the sale auction by the community leader. As a result of the studies carried out in marzpetaran, it was established that a legal regime of non-privatization was established with respect to the land plot, since this land plot was not transferable to citizens and legal entities by right of ownership by the virtue of Art. 60 of the RA Land Code.

 

On 15.09.2021 marzpetaran sent a letter regarding the cancellation of the auction and submission to a new auction of the sale after the cancellation of the legal regime in accordance with the established procedure due to restrictions on the alienation of the land plot.

 

In such conditions, however, the process of the auction by the municipality of Ptghni continues and by the auction of sale from 05.10.2021 the plot was alienated for 42.000.000 AMD.

 

In the meantime, during the preparation of the materials, factual data were also obtained that on 13.02.2012 by the decision of the elders of Ptghni community, the purpose of this land plot was changed to public construction.

 

On the fact of the case in Kotayk Division of Kotayk Regional Department of the RA Police, a criminal was instituted under Part 2 of Art. 308 of the RA Criminal Code, and the preliminary investigation of which is being carried out in Abovyan Investigative Department of the RA Investigative Committee.
