As part of the work envisaged by the work program of the RA Prosecutor General 's Office for 2021, the Department for the Protection of State Interests studied the state of protection of state interests in the process of alienating state real estate during 2016-2020.
As a result of selective studies, it was established that in relation to numerous property units (real estate) located in the city of Yerevan, in various regions of the Republic of Armenia, the processes of alienation of state property was carried out with corruption abuses.
In particular, the responsible officials of the RA State Property Department (former name), using their official position contrary to the interests of the service, violating the requirements of Part 2 of Art. 9 of the RA Law “On real estate evaluation”, without concluding an agreement, without legal grounds, offered the same company to carry out work on real estate evaluation.
During the specified period, the company's specialists made false conclusions about the evaluation of property at a cost significantly lower than the real value, which were approved by the director of the company.
These conclusions were subsequently used by the relevant authorities as a basis for the alienation of these real estate objects, they were alienated at a price several times lower than the real value. In the case of alienation of state property in this way, the initial damage caused to the state totals about 790 million AMD.
In other words, in many cases, the responsible officials of the State Property Management Department of the Republic of Armenia showed dishonest or negligent attitude towards service due to failure to fulfill their duties, improper performance or abuse of official powers.
In total, over the past year, the Department for the Protection of State Interests of the RA Prosecutor General's Office initiated 20 criminal cases under Parts 1, 2 of Article 308 or Part 2 of Art. 315 of the RA Criminal Code, and by 5 cases the results of the investigation were sent to the bodies conducting pre-trial criminal proceedings, along with other initiated cases to resolve the process.
A large-scale preliminary investigation is being carried out both on these and other criminal cases previously referred by the RA Prosecutor's Office. Results will be posted regularly.
