The Prosecutor submitted the case regarding the Director of “Vardenis Psychoneurologic Boarding House” SNPO and others to the court

K.Kh., the Director of “Vardenis Psychoneurologic Boarding House” SNPO, being informed about medical care provided to N.M., who was under guardianship of the SNOC employees, in violation of the law, improperly performed his official duties.

 

As a result, M.K., the doctor-psychiatrist of “Vardenis Psychoneurologic Boarding House” SNPO jointly with N.Z., the senior nurse, committed other wilful violent actions prescribed for by Article 195 (physical impact) of the Criminal Code against N.M., a resident of the SNPO, who had mental health problems and aggressive behavior.

 

In particular, they used physical restraint for a long time, more than 4 hours during the day, even the whole night: tying a metal chain on the cloth wrapped on N.M.'s abdomen, fixing it from a heating battery, they organized his life on a mattress on the floor.

 

As a result of the above-mentioned actions, significant damage was caused to the rights, freedoms and legal interests of N.M.

 

On the basis of the above-mentioned, on September 27, 2023, the Prosecutor initiated public criminal prosecution against K.Kh. under Part 1 of Article 441 of the Criminal Code, against M.K., under Points 5 and 6 of Part 2 of Article 46-195, against S.G., under Points 5 and 7 of Part 2 of Article 195, against Kh.A. under Points 5 and 7 of Part  2 of Article 195 and against N.Z., under Points 5 and 7 of Part 2 of Article 46-195.

 

The Prosecutor approved the indictment on October 12, 2023 and submitted it to the Anti-Corruption Court along with the files of the proceedings.
