A.M., having been the director of "TAGAR" LLC since 2017, while doing subsoil works at the north-eastern part of the Kakavadzor tuff mine, violating the clauses of the subsoil use contract for mineral extraction signed on September 2, 2016 for a period of 21 years, illegally used the crust in the total area of 2900.1 square meters, destroyed and dislodged 26,973.4 cubic meters of storm-like mountain mass until December 2020, causing significant damage to the subsoil and its minerals.

            

Based on the results of the study carried out by the employees of the Department of Geodesy and Land UseUrban Development, Technical Standards and Fire Safety Inspectorate, in 2019 a criminal case was initiated at Talin Police Department according to the Article 290 (destroying land) and part 2 of Article 291 (illegal subsoil use) of the Criminal Code adopted on 18.04.2003.

 

During the preliminary investigation, apparent facts were obtained that during the cunduction of the above-mentioned work, A.M., violating of the provisions of the Land Code and the Subsoil Code regarding the extraction, transportation, preservation and use of the soil placed industrial waste on the plots of land located in the administrative area of Kakavadzor municipality, without changing the area provided for mountain allocation, as well as purpose and operational significance of the plots of land adjacent to that area: as a result, the land was degraded, intentionally causing significant damage to the environment - in the amount of 13 million 442 thousand 43 AMD.

 

According to the expert's conclusion made during the preliminary investigation, the value of the natural use fee calculated for the liquidated stock of illegally used tuff, the damage caused to the state, amounted to 3 million 445 thousand 700 AMD. The company did not have an appropriate subsoil use permit, as well the state tax in the amount of 500 thousand AMD was not calculated and paid to the state budget.

 

A letter was sent to the SRC of the RA to calculate other types of taxes not paid as a result of illegal subsoil use by the company. According to the letter received from the SRC, the additional natural usage fee to be paid by the company was 10 million 955 thousand 59 drams, the amount of turnover tax was 1 million 443 thousand 988 drams, the amount of the state duty for a special permit was 500 thousand drams.

 

On 3 February 2022 a charge was brought against A. M.

On 13 March 2023, A. M. accepted the charges brought against him and fully recovered the damage caused: 14 million 243 thousand 290 AMD.
