As a result of studies conducted in the field of state interests protection during 2019 the Prosecutor's Office of Lori region found out that in some cases, by the decision of the head of the community, the unauthorized structures that were built in energy security zones were legalized, thus creating a real danger to human life and health.

 

For example, in Stepanavan community, 73 buildings were found out that were built in energy security zones by various violations, and in case of 71 were not taken measures to eliminate further violations.

 

For a long time, no measures were taken to eliminate violations of the energy security zones of air lines detected in communities operating in the administrative territory of the region by local self-government bodies, as a result of which the possible dangers threatening life and health of people, property and the environment were not neutralized. This issue can be resolved exclusively by the cooperation between closed joint-stock companies in the energy sector and local self-government bodies, as well as effective legal and professional supervision over the exercise of powers entrusted by the state to local self-government bodies in the manner prescribed by law.

 

Taking into account  the above mentioned, the Prosecutor of Lori region presented a petition to Marzpet with a proposal to exclude such phenomena from local self-government bodies, eliminate violations in energy security zones, neutralize possible dangers threatening life and health of people in these zones, exclude further legalization of unauthorized buildings.  

 

As a result, by the order of Marzpet of Lori region, a working group was created and during the study carried out by the group it was found out that there were violations of security zones along almost the entire length of 10 kW air lines and there were many more than 73 violations indicated in the petition. As a result of the consideration of the same petition, Marzpet of Lori region informed that from 73 buildings, in cases of 28 the violations were eliminated by Stepanavan branch of “ENA” CJSC. At the same time, it was reported that the head of Stepanvan community was informed about the studies and it was suggested to take urgent measures to eliminate violations detected in the safety zones of air lines, by paying particular attention to 15 buildings located in the safety zones.

 

Besides, by a circular letter from Marzpet of Lori region, the heads of the region’s communities were offered to coordinate the documents with all organizations providing public services in case of alienation of land plots, lease, as well as legalization of unauthorized buildings.

 

The Prosecutor’s Office of the region was also informed that, attaching importance to the resolution of the issue, Marzpet of Lori region presented to the RA Minister of Territorial Administration and Infrastructure the issue, and it was proposed to consider the issue with “ENA” CJSC and include in the programs implemented by the company or in other  investment programs the replacement of air lines 10 kW with per underground cable line.
