During 2019 in the field of protection of state property interests, the structural subdivisions of the RA Prosecutor's Office carried out large-scale works.

 

In particular, in the republican and in numerous areas of regional involvement in the issues of protection of state interests, a total of 1136 studies were conducted, which is by 11.4% more compared to 2018.

 

The studies included the areas of protection of state and public property, privatization, land use, road construction, nature protection, subsoil use, protection and management of water infrastructures, healthcare, and under the jurisdiction of the Military Prosecutor's Office, the military services, weapons, military medicine, capital construction.

 

According to the results of the study, 162 messages and petitions were presented to state bodies in order to take measures to restore damage caused to the state.

 

Prosecutors filed 76 lawsuits for the protection of state interests, demanding the recovery of about 1.67 billion AMD. The consideration of lawsuits with the demand of about 6 billion 35 million AMD is still in process.

 

According to the facts containing signs of a possible crime found out in the course of studies carried out by the subdivisions of the Prosecutor’s Office within the framework of the function of protecting state interests, 269 criminal cases were initiated, and the results of studies by 338 cases were sent to prepare materials according to the jurisdiction.

 

Criminal cases, in particular, were initiated on the facts of  embezzlement and squandering committed during the construction and repair of strategic facilities, in some cases, for state funds; illegal alienation of objects; management, leasing of state or municipal property; abuses committed in the investment areas, protection of monuments of republican significance, public procurement; the improperly performed works in the field of road construction; illegal exploitation of natural resources; privatization of numerous state-owned property through criminal violations of appraisal procedures; manifestations of criminal inaction under the conditions of non-fulfillment of contractual obligations in the field of garbage collection and sanitation and other numerous facts.

 

For the recovery of the damage caused to the state 332 physical and legal entities or compared to 2018 by 7.5% more people were warned. As a result during a year only with the use of the means of prosecutorial supervision about 1 billion 265 million AMD were returned voluntarily, which is by 172.6million AMD or 14.3% more compared to 2018.

 

By the measures taken by all subdivisions of the Prosecutor’s Office regarding the issue of the protection of state interests, the total damage caused to the state by lawsuits, initiated criminal cases and materials sent to the investigating bodies amounted to about 44.8 billion AMD, while the same indicator during 2018 amounted to about 37 billion AMD. Thus the result of 2019 compared with the previous year is by 31.6% more. Within the framework of initiated criminal cases, as well as filed lawsuits, measures are being taken to restore the damage. Thus, the damage caused to the state, revealed due to the work carried out during 2018-2019 in the field of protecting state interests, in total amounted to 82 billion AMD, which is by 2.5 times higher than the joint result of the previous 9 years.

 

At the same time, in the course of the study, as a result of the work carried out by the Prosecutor's Office on the basis of warnings, filed messages, in the period of 2019 about 1.4 billion AMD were restored. The Prosecutor's Office, within the framework of both criminal cases and lawsuits, controls the restoration, with the use of all the tools of influence, entrusted by law.

 

The provision of the presented indicators is primarily conditioned by a sharp increase in the level of cooperation of the Prosecutor’s Office with public circles, citizens, significant increase in the volume of the process of presenting to the RA Prosecutor’s Office data containing signs of a possible crime detected by state bodies with the use of internal supervisory levers. The results are conditioned by the large-scale studies carried out by subdivisions of the RA Prosecutor's Office, in particular, by the Department of State Interests Protection of the RA Prosecutor General's Office and the Division of State Interests Protection of the Central Military Prosecutor's Office of the Republic of Armenia, proper registration and appropriate assessment in case of revealing violations related to state interests.
