10 criminal cases of illegal real estate lease of community property in Gegharkunik region. 18 million drams was restored

The processes of revealing and criminal and illegal processes of leasing state and community-owned lands of the communities and restoring the damages caused to the communities are continued according to the instructions of the Prosecutor General of the Republic of Armenia

 

In particular, on the basis of materials prepared on the instructions of the Prosecutor's Office of Gegharkunik Region, RA, 10 criminal cases were initiated in the process of providing state and community-owned real estate for rent to the by telecommunication operators.

 

Besides, 7 of them were initiated in the framework of additional investigations carried out by the instructions of the RA Prosecutor General in addition to the State Control Service permanent cases in the scope of the additional studies.

 

In general, the criminal cases are on the former or acting leaders of Astghadzor, Geghamavan, Makenis community, Geghamasar enlarged community, Kut settlement, Chambarak community of Chambarak enlarged community, Ttu Jur, Martuni settlements, Shoghakat enlarged community of Aghberk settlement and Verin Getashen community.

 

Two of them have been initiated under Article 308, Part 1 of the RA Criminal Code, and 8 cases on the grounds of Article 308, Part 2 of the RA Criminal Code.

 

According to the materials of the criminal case, state or community-owned agricultural land has been leased by community leaders to community leaders, their relatives or subordinates, sometimes through fictive tenders, at significantly lower market fees, and then a small portion of that land has been rented several dozen times higher since 2004. In the result, some individuals have benefited greatly from the use of shared land, and communities have been deprived of receiving financial means.

 

The total damage caused to the above-mentioned communities of the region in the scope of the above-mentioned cases amounted to 56,074,199 AMD, out of which 18,115,075 AMD was restored. Measures are also being undertaken to restore the rest of the damage.

 

Four people (former leaders or acting leaders of communities) in 4 criminal case have been charged under Article 308, Part 2 of the RA Criminal Code.

 

Though, given that they have fully or partially restored the damages caused to the communities in the state of suspects or defendants, or have expresses their preparadeness to fully compensate the rest of the damage during the investigation, confessions were given and they were not taken under custody.

 

With the cooperation of the Prosecutor's Office of the Region, Marzpetaran and the  preliminary investigation body, the regional administration and the relevant local self-government bodies, measures are being undertaken to restore the legitimate interests of the communities, to resolve illegal lease agreements, to sign new agreements between communities and communication operators in accordance with relevant RA domestic legislation. In particular, such a procedure has already been undertaken in 7 communities.
