The Prosecutor's Office took measures against the prosecution of former officials of the Republic of Armenia and Artsakh announced by the Republic of Azerbaijan

November 28, 2020

Recently, referring to the official sources of the Republic of Azerbaijan, the media published information on the initiation of criminal prosecution by the Azerbaijani authorities against former Defense Minister Seyran Ohanyan, MP Arman Babajanyan, President of the Republic of Artsakh Arayik Harutyunyan, former Defense Minister of the Republic of Artsakh Jalal Harutyunyan and putting them on international wanted list.

Considering that the persecution of these persons by the competent authorities of the Republic of Azerbaijan has no legal basis, in fact, it is a logical continuation of the military actions carried out by the military-political leadership of the Republic of Azerbaijan, the Prosecutor General 's Office of the Republic of Armenia, after being informed about this, took preventive measures against the illegal prosecution.

In particular, in connection with the above, the RA Prosecutor General's Office, together with the Interpol NCB of the RA Police, informed the General Secretariat of the International Criminal Police Organization (Interpol) about the factual data of the unleashing an aggressive war against the RA and Artsakh by the military-political leadership of the Republic of Azerbaijan in violation of a number of requirements of international treaties, on the recruitment and use of mercenaries, members of various terrorist groups specially recruited by Azerbaijan for remuneration in the hostilities, commission of war crimes with gross violations of customary international humanitarian law with the use of prohibited means and methods of war based on national hatred.

Measures were taken to prevent illegal prosecution attempts through the General Secretariat of Interpol, and in case of receiving requests for putting on a wanted list -  not including the data in the relevant Interpol databases. In this regard, first of all into account was taken the fact that according to Article 3 of the Charter of Interpol, organization is strictly prohibited from engaging in or interfering in matters of a political, military, religious or racial nature.

The RA Prosecutor's Office consistently pursues the goal of preventing Azerbaijan's attempts to use other intelligence channels on the same grounds. Taking into account that this process, by its nature, contains a significant privacy component, it is impractical and impossible to provide further details.

As a result of effective cooperation with foreign partners, since 2017, the RA Prosecutor's Office has taken political steps to take consistent measures in connection with the requests initiated by Azerbaijan on political, which have given significant positive results in practice.

For example, in connection with Azerbaijan's attempts to put on the international wanted list for criminal prosecution of persons who visited Artsakh and those who carry out activities there, the General Secretariat of Interpol took a position on recognizing the investigations of these cases as inconsistent with Article 3 of the Charter of Interpol, therefore, the General Secretariat of Interpol in connection with such requests does not take any action by such requests.
