A criminal case was instituted on May 7, 2020 under Article 308, Part 2 of the RA Criminal Code regarding corruption abuses in Agarak administration of Syunik Marz committed in the process of leasing and sub-leasing of land plots belonging to the community.

 

It was founded by a sufficient combination of evidence obtained in the result of preliminary investigation carried out by the Investigation Department of the RA Investigative Committee that the resident of Agarak town, having won the bid announced by the Agarak community administration on 16.02.2007, acquired agricultural plots of land situated in the southern lines of Agarak community for 25 years with an annual rent of 18,000 AMD for 0.02 ha of, which was leased to a telecommunication operator company for a monthly rent of 50000 AMD / 600.000 AMD yearly/ on the basis of a contract signed by the head of the community.

 

M. Z, who was the head of Agarak community from November 13 of 2008, later from September 24 of 2016 the head Meghri enlarged community, being aware of the use of the mentioned land for non-operational purposes as a communication object land for location of a mobile station and about the rent which exceed in times, instead of exercising his authority of preventing, suspending or eliminating illegal land uses, terminating the lease agreement concluded between the citizen, an agreement was concluded with the citizen on April 1, 2009 on behalf of the community, according to which the rent of the land leased by the latter was changed to 300.000 AMD per year instead of 18.000 AMD. And on July 27, 2011, instead of meeting the requirements of the legislation, he was fined with hundred times of the minimum wage in the Republic of Armenia for violating the obligation to use the land for its intended operational purpose.

 

In the result, from November 13, 2008 to January 2021, the community budget was paid 3․657․500 AMD instead of 7․350․000 AMD was paid to the budget of the community, which caused serious consequences, in particular, 3․692.500 AMD was not paid to the community budget.

 

M. Z. has been charged under Article 308, Part 2 of the RA Criminal Code according to the decision made by the Prosecutor of the RA Syunik Region Prosecutor's Office, who supervised the legality of the criminal case under preliminary investigation.
