The structural subdivisions of the RA Prosecutor's Office have continued their extensive work in the field of state property interest protection during 2020, despite the state of emergency in the Republic as well as the legal regimes of martial law and the difficulties resulted by them.

 

In particular, during the previous year, a total of 819 investigations were conducted by all structural subdivisions of the Prosecutor's Office on state interest protection in the result of which 763 violations were detected. The studies have included state protection of public property, road construction, energy, subsurface use, water bio-resources, infrastructure management, healthcare, education, public procurement, and military prosecutor's office, military service, military housing means, military medicine, military medicine, capital construction and other spheres.

 

Prosecutors have warned 153 people in order to cover the damage to state interests voluntarily. In the result of this measure of prosecutorial influence 512 million AMD was voluntarily restored to the state budget.

 

In the result of the studies 77 applications were submitted to the state bodies in order to undertake measures to recover the damage caused to the state, to file lawsuits to protect state interests, as well as to eliminate the causes of violations of state interests.

 

Prosecutors have filed 56 lawsuits to protect state interests to the court, totally about 620 million AMD demand. 33 suits out of 44 lawsuits examined in the courts, including those initiated in previous years, granted the claim of 4.6 billion AMD, which is about 65 times more compared with the results of 2019. 95 lawsuits with a claim of about 6.9 billion AMD are being investigated.

 

In the result of the investigations carried out by the subdivisions of the Prosecutor's Office in the scope of the function of protection of state interests, 249 criminal cases were initiated and the outcomes of the investigations were sent to prepare materials on 440 cases.

 

The criminal cases have been initiated, in particular, in the procedures of privatization of numerous state-owned properties, repair  of community roads, use of state funds in certain social areas, procurement for the needs of state bodies, lease of state or community property plots, industrial fishing from Lake Sevan, substantial abuses registered in many of those areas.

 

The total damage caused to the state amounted to 21.4 billion AMD which was found by the measures undertaken by all the subdivisions of the Prosecutor's Office during 2020 in regard with the issues of protection of state interests, lawsuits, criminal cases, materials sent to investigative bodies. About 1.6 billion AMD was restored.

 

The outcomes recorded in the field of state interest protection continue to be conditioned by the results of inspections carried out by state bodies having such supervision.
