In the result of the study carried out at the Department of State Interests Protection of the RA Prosecutor General’s Office circumstances of criminal abuse was found out regarding alienation of the property of the “Yerevan Jewelry Plant” OJSC, the 80% of which was state share.

 

In particular, in the result of the study of the documents requested and received by the RA State Property Management Committee and Compulsory Acts Enforcement Service it turned out that in the scope of the civil case “N” according to the acts of the First Instance Court of General Jurisdiction and the Civil Court of Appeal 56 million AMD amount of state duty should be confiscated from “Yerevan Jewelry Plant” OJSC in favor of the RA state budget.

 

In order to confiscate the court gave an enforcement order on 6 of March 2019 on the ground of which according to the decision of the Compulsory Acts Enforcement Service an enforcement proceedings were initiated on 7 of March 2019, the property of the OJSC was seized. And according to the Decision of enforcement officer by 24 February 2020 a LL company was appointed as an expert and the latter was nominated to estimate the price of the property belonging to Yerevan Jewelry plant – valuable property consisting of gold and brilliant goods.

 

It turned out that the book value was 83.5 million AMD.

 

According to the data received in the result of the study those goods with the value of 83.5 million AMD were estimated 2.5 times less – only 38.3 million AMD than its book value.

 

Later, the highly valued property was submitted to a compulsory electronic auction, in the result of which a citizen acquired it at a price of about 4 times lower than the book value, for only 21.5 million AMD.

 

So, the employees of the mentioned LLC, abusing their authorities against the interests of the organization, prepared a calculation not corresponding reality, submitted it to the Judicial Acts Compulsory Enforcement Service, in the result of which the property was sold at an electronic auction at a price much lower than its real (book) value causing heavy consequences for “Yerevan Jewelry Plant” OJSC – damage about 50 million AMD.

 

Taking into account that the study showed features of criminal acts abusing authority, causing significant damage, serious consequences by employees of commercial or other organizations, the Department of State Interests Protection of the RA Prosecutor’s General Office initiated a criminal case according to Article 214, Part 2 of the RA Criminal Code.

 

Earlier it was informed that in the result of not fulfilling the shortcomings by "Yerevan Jewelry Plant" OJSC submitted by the Court Cassation the OJSC it will be deprived of the possibility to receive more than 1 billion AMD debt. Another criminal case was initiated at the Department of State Interests Protection of the General Prosecutor's Office of the Republic of Armenia in accordance with Article 315, Part 2 of the Criminal Code of the Republic of Armenia for about 516 million AMD state debt.
