The prosecutor of Lori region appealed to marzpet with a request to restore the violated rights of the Hartagyugh community, strengthen control

By the combination of sufficient evidence acquired during the preliminary investigation of the criminal case, investigated on the grounds of Part 1 of Art. 308 of the Criminal Code of the Republic of Armenia in the investigative department of Spitak of the Investigative Committee of the Republic of Armenia Harutyunyan Andranik, the head of the Hartagyugh community of Lori region, was charged under Part 1 of Art. 308 of the Criminal Code of the Republic of Armenia.

 

The latter was accused of being the head of the community, having been notified in advance of the intention of the telecom operator to install and operate an antenna station on a land plot owned by the community, on April 10, 2017 submitted for approval by the Council of Elders a decision to transfer 0.04 hectares of agricultural land into the category of lands of objects of operational, communication, transport and communal infrastructure.

 

Shortly thereafter, the mayor, through his son, leased the same piece of land to a telecommunications company for a monthly rent of 40000 AMD. As a result, he received a total profit of 1,240,000 AMD in June. Thus, the rights of Hartagyugh community were harmed, depriving the latter of the opportunity to receive the same income.

 

On January 26th, 2021 the criminal case with the indictment was sent to the court of general jurisdiction of first instance in Lori region.

 

During the preliminary investigation and trial, the material damage inflicted on this community was restored.

 

By the court verdict dated May 11, 2021 Harutyunyan Andranik was found guilty of committing the act incriminated to him.

 

Considering that the verdict came into force, the prosecutor of Lori region of the Republic of Armenia appealed to marzpet of Lori region with a petition and stressed the need to exercise supervision over the provision of land claims by land users.
