The Prosecutor General’s Office made a decision on public criminal prosecution against a judge

The Prosecutor General’s Office informed on 11 October that according to Article 161, Part 1 of the RA Judicial Code, the RA Prosecutor General brought a motion to the Supreme Judicial Council to initiate criminal prosecution against the judge.
The Supreme Judicial Council, according to procedures and timelines envisaged by the same code, convened a meeting and made a decision to deny the petition on the ground that the case of disclosed crime is not connected with the competitions of the judge, when the consent of the Supreme Judicial Council is not required.
The above-mentioned decision of SJC does not exclude the criminal prosecution against the judge, moreover, overcoming the immunity of the judge is not required for criminal prosecution.
On 12 October 2022 a decision was made on the above-mentioned to initiate public criminal prosecution against the judge A. H. for assisting legalization of a particularly large property obtained by criminal means and for submitting false data in the declaration which is envisaged according to Article 38-190, Part 3, Point 1 and Article 314.3. Part 2 of the Criminal Code adopted on 18 April 2003.
The decision has been sent to the Supreme Judicial Council for information purposes, as well as to the investigation body - to file a charge.
