A.P., accused for assisting state treason, was arrested. The Court of Appeal granted the appeal of the prosecutor
November 28, 2022
On 21 November 2022, the Court of Appeal upheld the appeal submitted by the prosecutor and overturned the decision of the First Instance Court of General Jurisdiction of Yerevan City, recognizing as inadmissible the bail release of A.P., who is accused for assisting state treason.
In the frame of the criminal proceedings initiated by the National Security Service, information was obtained that A.P., being a citizen of the Republic of Armenia, assisted her husband in committing state treason. In particular, in 2021, A.P., at the request of her husband, found out the location address of one of the military units of the RA Armed Forces with the help of her relatives, and in exchange for a certain amount of money, in order to hand it over to representatives of foreign intelligence and she informed her husband. The latter transferred the information to foreign specialized services.
On April 29, 2022, the criminal proceedings were sent to the court with an approved indictment. On October 11, 2022, the Court of General Jurisdiction of the city of Yerevan, after examining the petition of the lawyer regarding A.P., changed the chosen preventive measure of detention and applied a preventive measure not related to imprisonment. A special review appeal was filed against the said court act by the prosecutor defending the charge, which was granted by the Court of Appeals on November 21, 2022.
The court, in particular, took into account the nature of the act, its public danger, as well as the factual data confirmed by the criminal proceedings, which give grounds for considering that the accused may have illegal influence on the persons participating in the criminal proceedings, and the fact that the bail was paid cannot neutralize the possibility of his illegal behavior.
The decision of the Court of Appeal was sent to Gegharkunik Regional Department of the Police for execution.
