A disciplinary Penalty “Reprimand” was imposed against the Head of territorial division of the Prosecutor’s Office by the order of Anna Vardapetyan, Prosecutor General, dated the 23rd of December, 2023.

 

After initiating the criminal case N, the Head of the territorial division did not take effective measures to properly implement the prosecutor's supervision, despite the fact that the investigator did not perform any investigative and administrative actions for about 5 months.

 

As a result, preliminary investigation was not conducted in the frameworks of the criminal case (proceeding), not all the necessary measures, stipulated by the law, were taken within a reasonable period.

 

Besides, the Head of the territorial division of the Prosecutor's Office, in the absence of legal grounds, made a decision on extending the preliminary investigation’s period in order to satisfy the motion of the investigator.

 

Due to the existence of a distant family relationship between him (the prosecutor) and the victims of another criminal case and the accused (defendant), the prosecutor did not submit recusal and continued to perform the duties of the accuser within the framework of the criminal case until he was removed from the proceedings.

 

Suspicion is caused by the combination of the following circumstances: violations, delays, consanguinity, but not the kinship itself.
