On December 28, 2018 K.A. director of AQUILA TECHNICS LLC, registered in the Republic of Armenia signed a contract with the RA Civil Aviation Committee (hereinafter referred to as “the Committee”) undertaking to ensure the maintenance of N airplane.

 

In the scope of the criminal proceedings initiated in the General Department of Investigation of Particularly Important Cases of the Investigative Committee it was found out that in May 2021 K.A. being informed of the need to replace (due to corrosion) the «THS Actuator» spare part of the airplane  and being informed that the spare part may be obtained from the English company—«Avtrade limited» (USD 200 000), submitted a letter to the Committee on May 7, 2021 with a false content and suggested buying a used spare part  from the Brightcom Aviation Ltd (Cyprus) that did not existed at that time for USD 310 000.

 

 The prosecutor supervising the criminal proceedings gave several assignments to the investigator conducting the proceedings and some procedural actions were carried out for the purpose of execution of the mentioned assignments.

 

Due to the above-mentioned actions it was found out that as a result of the alleged crime a damage in the amount of AMD 102 350 371 was caused to the state. On December 23, 2022, the mentioned amount was completely transferred to the deposit account of the Investigative committee.  

 

On February 13, 2023, as a result of examination of the materials of the criminal proceedings, the supervising prosecutor made a decision on initiating a public criminal prosecution against K.A under point 1 of part 3 of article 178 and part 1 of article 325 of the RA Criminal Code, that was in force at the time of commission of the offence.

 

On the same day the materials of the criminal proceedings and decision on initiation of public criminal prosecution against K.A. were sent to the investigator conducting the proceedings to discuss the issues of bringing charges against K.A. and applying relevant measure of restraint against him.

 

Notice:  A person charged with any crime shall be presumed innocent until proved guilty in the manner prescribed by the RA Criminal Procedure Code—by the judgment came into legal force.
