The prosecutor filed a public criminal prosecution against A.A. under points 3, 4, 6 of part 2 of article 196 (causing severe physical pain or severe mental suffering with a particular cruelty towards the minor), points 1 and 2 of part 3 of article 198 (violent actions of sexual nature towards a person not having attained the age of 12-14 by an upgoing relative or a person who is responsible for upbringing, care or treatment of the child),  points 1 and 2 of part 2 of article 239 (inducing or engaging a child in committing acts related to pornography or preparation or dissemination of materials or objects of pornographic nature by the person who is responsible for upbringing, care or treatment of the child, using information or communication technologies,) points 1 and 2 of part 3 of article 300 (preparing, disseminating or maintaning pornographic materials or objects committed by a close relative which was combined with a cruel attitude towards a minor) of the Criminal Code. 

 

Under the criminal proceedings it was found out that with the intention of preparing a child pornography with the participation of her 12 years old daughter and realizing it through the communication means for the purpose of satisfying the sexual needs of other people A.A. prepared and realized child pornography showing a cruel attitude towards her minor daughter.  During the process of preparation of child pornography she caused a severe physical pain to her minor daughter, abusing her and committing acts of sexual nature. She also involved her two daughters (who have not attained the age of 12) in the process of preparation of the material of pornographic nature.
