L.A., the Acting Head of the Sarukhan community having been authorized to supervise over the implementation of the community budget since 7 September 2017 to 27 October 2018, did not commit his official duties.

 

Factual data has been obtained during the criminal proceeding undertaken in the Gegharkunik region that E.V., Secretary of Staff of the Sarukhan Municipality collected 13 million 508 thousand 328 AMB as vehicle property tax and took it unlawfully. Later he gave the mentioned amount back to I.B, a first class specialist of the municipality as compensation for the damage caused and also paid 14 million 113 thousand 894 AMD as a fine.

 

In his turn, I.B. in the period of 1 November 2016 to September 2017, embezzled particularly large amount of money (5 million 950 thousand AMD) and handed it over to H.Ch., the Head of the Community (died in 2017 and did not return the money). I.B. did not enter the mentioned money into the community budget with the support of H.Ch., the Community Head, on the condition of returning it later. I.B. also tokk 11 million 934 thousand 454 AMD unlawfully in the period of 7 September 2017 to 31 December 2017.

 

In the period of 7 September 2017 to 27 October 2018, L.A., the Acting Head of the Sarukhan community, being aware of the above mentioned did not exercise any control over the implementation of the community budget and did not undertake any measure to return the money back to the community budget for the benefit of personal and group interests.

 

As a result, property damage of 17 million 884 thousand 454 AMD was caused to the legal interests of the Sarukhan community.

 

E.V., the Secretary of Staff of the Sarukhan community and I.B., a first class specialist of the municipality were charged under Point 1, Part 3 of the Article 179 of the Criminal Code of the RA adopted in 18.04.2003.

 

A criminal prosecution against H.Ch., was not initiated given the fact of his death on 29 August 2017. I.B, the first class specialist also died during the trial and a decision was adopted to stop the criminal prosecution against him.

 

E.V., Secretary of Staff of the Sarukhan community recovered the damage caused by him. An amnesty was applied to him.

 

On 28 October 2022, L.A., the Acting Head of the Sarukhan community was charged by the decision of First Instance Court of Gegharkunik region and a fine of 250,000 AMD was imposed on him as a punishment.

 

The Prosecutor’s Office of the Gegharkunik region has submitted a motion to the Municipality of Gavar, Gegharkunik region on initiating a civil suit in order to recover the damage caused to the community.
